They can because of the intellectual property rights the Cubs own. I know, I know, the words "intellectual" and "Cubs" usually don't belong in the same sentence. They are not being chased away because they are trespassing on someone else's property, but because the Cubs have to defend their intellectual property (Bayer failed to do that with "Aspirin" and lost the ability to prevent other companies from using the word to describe their product which is like Bayer's product).

Is he making money off of their product? I know that's how they dinged the roof top owners. Obviously, I get the fact he can't be using the Cubs logo, brand, etc.

Whether someone is making money off another's intellectual property is irrelevant. The issue is that the property belongs to the owner, the Cubs, and it cannot be used, except in some very limited settings, by someone else.

What about this is the intellectual property of the Cubs? Are you talking about the jersey and helmet? Because that's probably a flimsy case at best.

OK, so hypothetically, lets say one of these idiots is dressed in the costume and are at John Barleycorns/Red Vines/Bar Louie, etc. A couple of "heavies" from the Chicago Cubs can come in to the bar, which is private property, not Cubs property, and kick him out ? I really don't think that's true. They can hand him a cease and desist letter, telling him to stop running around dressed like a Cub, but that's about it. They can't physically remove him. The owners of the bar can. I would just think the Cubs would pressure the owners of the bars not to let the guy in.

It is actually very strong. The logos on the jersey and helmet are registered trademarks. The use of the logos is controlled by MLB and the Cubs.

They can't kick them out of Barleycorm, they can make them stop doing what they're doing with the logos, however. If they don't stop, the Cubs' potential damages in a lawsuit keep increasing.

I know you're a lawyer so you would know this better than me, but by that logic couldn't the Cubs (or any entity with a registered trademark) sue anyone who wears a Cubs logo and does anything they disapprove of?

Who do you think keeps buying him tickets to games at The Urinal and Comiskey, not to mention Spring Training games? Who paid for his new teeth which are perfectly aligned and pearly white? I don't know, but he certainly has friends in high places......

Woo Woo probably creates an atmosphere the Cubs want to promote (harmless cheering on the team) vs. these clowns who are trying to get tips and seem to get upset when stiffed.
